In August 2020, I bought unit 1105 at N. Court Street, Apt. 202, Rockford, IL 61103, as advertised on Zillow as a 2-bedroom, 2-bathroom condominium with the added perk of “Also includes private access to unit exclusive patio area.” However, despite this, Winnebago County classifies it as a one-bedroom property.
The Garrison Loft & Town Homes Master Association contradicts the listing, asserting that the Private Patio Area of Loft 202, as labeled on the door, was not a limited common element, and they removed it after three years. There is disagreement among members of the Master Association and Garrison Lofts Condominium Association on whether the area is deemed common area or common element.

In an attempt to resolve this inconsistency, I reached out to the listing broker to inquire about potential false or misleading statements in the listing stating, Did your listing for 1105 N Court Street, APT 202, Rockford, IL 61103 contain any false or misleading statements that lied or made false claims about the property or services offered?
The broker replied, “This was a past listing of mine that has been sold and closed. Thanks for reaching out and enjoy the rest of your weekend!”
Pressing further, I highlighted the disparity concerning the private patio area and sought a clear answer: “
I need to know if your listing for 1105 N Court Street, APT 202, Rockford, IL 61103 contains any false or misleading statements that lied or made false claims about the property or services offered.
Can you simply answer, yes, or no?” Regrettably, no response was received.
